Section 30.10 - Fines and revocation of license

(a) Any licensee which willfully refuses to file a monthly report, or to pay a licensee fee and/or additional fee after a determination by the commissioner, or files a monthly report which is willfully false or willfully fails to keep the records required by this Part, may be subject to a fine, not to exceed two times the annual license fee, as determined by the commissioner.

(b) Any license to operate a major facility may be revoked by the commissioner where the licensee has failed to comply with the terms of the license or any special conditions or requirements contained therein.

(c) The determination of whether a fine should be assessed and the amount thereof, or whether a license should be revoked, shall only be made by the commissioner after a hearing before a hearing officer appointed by the commissioner which is conducted in accordance with the provisions of the State Administrative Procedure Act.
