Exempt acts include:

1. All highway maintenance activities, including but not limited to:

Pavement maintenance, including resurfacing.

Shoulder maintenance.

Roadside maintenance.

Maintenance of drainage systems.

Maintenance of bridges, including painting or repair by contract.

now and ice control.

Equipment maintenance.

Rest area maintenance.

Maintenance of traffic control.

Maintenance of pavement markings.

The execution of agreements for maintenance jurisdiction.

Fabrication, installation and maintenance of signs for existing facilities.

2. All waterways maintenance activities, including but not limited to:

Repair and replacement of riprap, concrete and bank protection.

Excavating silt refill to restore channels to design dimensions and removal of other debris from existing channels.

3. Maintenance of toll facilities, department offices, service areas and maintenance facilities.

4. Actions necessitated by emergencies, including but not limited to:

Cleanup of flood and storm damage.

Emergency local assistance.

Accident cleanup.

5. Approval and execution of contracts for the rehabilitation, maintenance or repair of existing transportation facilities or structures not involving an expansion of the facility or structure.

6. Approval and execution of contracts for the purchase of equipment which will be used to rehabilitate, maintain or repair existing transportation facilities or structures.

7. Collection of tolls at existing toll barriers, including necessary administrative actions.

8. All ministerial acts, including those listed in Appendix A-16.
