Section 68.8 - Use of slow-moving vehicle emblem

The only use of the SMV emblem shall be as follows:

(a) Agricultural equipment, whether towed or self-propelled, designed for operation at speeds not in excess of 25 miles per hour when traveling on or moving along a public highway during day or night, shall each display the slow-moving vehicle emblem.

(c) Every vehicle drawn by animals shall display on the rear either:

(1) a slow-moving vehicle emblem; or

(2) a lighted lantern with a red lens at least four inches (10.16 centimeters) in diameter, the center of such lens to be 42 inches (106.68 centimeters) above the ground, the lantern to be near the left edge of the vehicle, and at least 72 square inches (309.648 square centimeters) of a high quality white or whitish-gray reflective tape.

(d) Every self-propelled unit of road construction and maintenance machinery or other machinery designed for operation at speeds not in excess of 25 miles per hour when traveling on or moving along a public highway during day or night shall display the slow-moving vehicle emblem except when engaged in actual construction or maintenance work either guarded by a flagman or clearly visible warning signs, and except that a hazard vehicle as defined in section 117-a of the Vehicle and Traffic Law engaged in a hazardous operation as defined in section 117-b of the Vehicle and Traffic Law shall not be required to display a slow-moving vehicle emblem when the amber light is legally being used upon such unit.

(e) A slow-moving vehicle with emblem attached and visible from the rear while being transported upon another vehicle, other than a slow-moving vehicle, shall have the emblem covered in such a manner that it will not be visible to traffic.

(f) The SMV emblem shall not be put to any use other than prescribed by this Part.
