Section 49.4 - Procedures for securing approval

(a) Two samples of safety belts, including attachment settings, labeled package or container and instructions for installing, shall be shipped, postage prepaid, to the Commissioner of Motor Vehicles, Empire State Plaza, Albany, N.Y. 12228, together with a certification and report of testing results from any unbiased laboratory acceptable to the commissioner, that the assembled safety belt meets with the statutory requirements of section 383 of the Vehicle and Traffic Law and this Part.

(b) In lieu of approval under subdivision (a) of this section, approval shall be deemed to be granted upon the receipt by the Commissioner of Motor Vehicles of a certificate of equipment approval issued by the American Association of Motor Vehicles Administrators to the Commissioner of Motor Vehicles, Bureau of Automotive Safety Standards, Empire State Plaza, Albany, N.Y. 12228.
