Section 35.2 - Definitions

(a) Commissioner.

The Commissioner of the New York State Department of Motor Vehicles.

(b) Continuous insurance coverage.

Insurance coverage that is maintained without interruption during the registration period as required by law. Such continuous coverage shall be with one insurance company or multiple insurance companies. If there are multiple companies, the effective date of the superseding coverage shall coincide with the cancellation effective date of the prior coverage so that there is no lapse in coverage.

(c) DMV or department.

The New York State Department of Motor Vehicles.

(d) Driver's license.

A New York State driver's license or a New York State learner's permit.

(e) Insurance coverage.

That portion of a motor vehicle liability insurance policy required by section 311.4 and section 370 of the New York State Vehicle and Traffic Law.

(f) Insurance identification (ID) card.

Proof of insurance, including an insurance certificate, issued in accordance with Part 32 of this Title.

(g) Lapse of insurance coverage.

An interval of time or gap between the cancellation effective date of insurance coverage and the effective date of:

(1) acceptable proof of superseding or reinstated insurance coverage as defined in this Part;

(2) acceptable proof other than insurance as defined in this Part;

(3) surrender of registration; or

(4) expiration of registration.

(h) Proof of insurance.

Acceptable proof of insurance may be in electronic or documentary form. Acceptable electronic proof of insurance shall mean an insurance notice submitted by an insurance company and received in DMV's value added network (VAN) mailbox that is matched to a registration record and posted to DMV's insurance information database. Acceptable documentary proof of insurance shall mean a document or documents (originals or copies, including facsimile or electronic copies) issued by an insurance company or other entity received, and deemed a sufficiently detailed, accurate and reliable proof of insurance by a DMV issuing office or the Insurance Services Bureau in the department's central office.

(i) Reinstated insurance coverage.

Replacement insurance coverage provided by the same company that cancelled such insurance.

(j) Rescission of suspension or revocation.

A cancellation of a suspension or revocation order as of the effective date of the suspension or revocation order. A rescission of suspension or revocation shall not excuse any penalties incurred for operation of the affected vehicle or any other vehicle while such order is in effect.

(k) Revocation of registration and/or driver's license.

The permanent cancellation of registration and/or driver's license or driving privilege for a definite period of time. Application for an original registration and/or driver's license or driving privilege may be made upon the fulfillment of specified conditions. Registration revocation orders shall be mailed to the address on DMV's electronic registration file. Driver's license revocation orders shall be mailed to the address on DMV's electronic license file.

(l) Suspension of registration and/or driver's license.

The temporary withholding of a registration and/or driver's license or driving privilege for a definite or indefinite period of time. Suspended items may be returned upon the fulfillment of specified conditions. Registrant inquiry letters and registration suspension orders shall be mailed to the address on DMV's electronic registration file. Driver's license suspension orders shall be mailed to the address on DMV's electronic license file.

(m) Termination of suspension or revocation.

A suspension or revocation shall be terminated upon the fulfillment of the requirements set forth in a suspension or revocation order. A termination of suspension or revocation notice shall not be sent to a registrant or licensee when all requirements to terminate such suspension or revocation including serving the suspension or revocation period are met. A termination notice shall be sent to a registrant or operator (driver) when the requirements for terminating a revocation issued for an uninsured accident are met.
