Section 32.9 - Types of ID cards and specifications

(a) There shall be two basic types of ID cards, a temporary ID card and a permanent ID card. Each type of ID card shall conform to the specifications prescribed by this Part.

(b) Permanent ID cards.

Permanent ID cards shall be issued by all types of insurance companies and licensed authorized agents and brokers as well as by the department for self-insurers and financial security depositors. Each ID card shall consist of at least two identical parts, 5 inches through 81/2 inches in width by 3 inches to 51/2 inches in height, printed on stock not lighter than 20-pound white bond, and shall bear the title "NEW YORK STATE INSURANCE IDENTIFICATION CARD" and the form numbers prescribed by this Part. Minimum size: 3" X 5". Maximum size 51/2" X 81/2". ID cards shall be computer issued. Portions of the required information, such as the legally required statements, may be pre-printed. ID cards shall contain the compliant encrypted 2D bar code security feature produced in full accordance with the specifications prescribed by this Part and DMV technical documentation.

(c) Temporary ID cards.

Temporary ID cards (FS-21) shall only be issued by an insurance company licensed by the New York State Department of Financial Services to write primary motor vehicle liability insurance coverage in New York State or such insurance company's authorized producers licensed by the New York State Department of Financial Services. Temporary NYAIP ID cards (FS-75) shall only be issued by producers who are both certified by the NYAIP and licensed by New York State Department of Financial Services in full accordance with procedures and systems established by the NYAIP. Each ID card shall consist of at least two identical parts, 5 inches through 81/2 inches in width by 3 inches through 51/2 inches in height, printed on stock not lighter than 20-pound white bond, and shall bear the title "TEMPORARY NEW YORK STATE INSURANCE IDENTIFICATION CARD" and the form numbers prescribed by this Part. Minimum size: 3" X 5". Maximum size: 51/2" X 81/2". ID cards shall be computer issued. Portions of the required information, such as the legally required statements, may be pre-printed. ID cards shall contain the compliant encrypted 2D bar code security feature produced in full accordance with the specifications prescribed by this Part and DMV technical documentation. Temporary ID cards (FS-21) provided in conjunction with a new policy shall be issued for a period of 60 days except as limited by section 32.3(g) of this Part.

(d) Each ID card shall contain the following information on the front of each part:

(1) The title: NEW YORK STATE INSURANCE IDENTIFICATION CARD, TEMPORARY NEW YORK STATE IDENTIFICATION CARD, NEW YORK STATE DEPARTMENT OF MOTOR VEHICLES INSURANCE CERTIFICATE-FOR HIRE PASSENGER VEHICLE or NEW YORK STATE DEPARTMENT OF MOTOR VEHICLES CORPORATE SURETY BOND-FOR HIRE PASSENGER VEHICLE, as applicable.

(2) DMV assigned insurance company code (ICC).

(3) Insurance company name.

(4) Name and address of the insurance company, agency, brokerage, agent, broker or the NYAIP that issued the ID card. The NYAIP is authorized to assign eligible risks to insurance companies licensed to write primary motor vehicle liability insurance coverage in New York State.

(5) Name and address of the insured registrant or insured registrants, if two individuals, printed in full accordance with the requirements set forth in this Part.

(6) Policy number except that on a temporary ID card any method by which an insurance company can identify the insured and vehicle is acceptable.

(7) Effective date, except as provided for in section 32.15 of this Part, including month (MM), day (DD), year (YYYY) and time (12:01 a.m.). Insurance companies may computer or machine print the word Renewal on permanent ID cards and, if they do so, such cards shall be acceptable, as is required, for processing a registration renewal prior to the effective date of coverage as long as the policies have not lapsed.

(8) Expiration date, except as provided for in section 32.15 of this Part, including month (MM), day (DD), year (YYYY) and time (12:01 a.m.).

(9) Description of vehicle including year (YYYY), make and an accurate and complete vehicle identification number (VIN) and number of seats (For-Hire registration classes only).

(10) The applicable certification statement prescribed by section 32.9(e) or section 32.15 of this Part.

(11) The applicable form number as set forth in the Appendices of this Part.

(12) Other required or permitted wording such as "REPLACEMENT VEHICLE", "HISTORICAL" or "TOW TRUCK" as is appropriate.

(13) Applicable wording set forth in the Appendices of this Part for the specific types of ID cards to enable identification of the required data elements, e.g., "Policy Number", "Bond Number", "Applicable with respect to the following Motor Vehicle:"

(14) The statement: "(Not acceptable to obtain registration after 45 days from effective date)".

(15) A compliant encrypted 2D bar code produced in full accordance with the specifications prescribed by this Part and DMV technical documentation.

(e) Certification statements.

See also section 32.15 of this Part for FS-75.

(1) Authorized insurance company (FS-20 and FS-21): "An authorized New York insurer has issued an owner's policy of liability insurance complying with article 6 (Motor Vehicle Financial Security Act) of the New York Vehicle and Traffic Law to:"

OR

Authorized insurance company (FS-20 and FS-21): "An authorized New York insurer has issued an owner's policy of liability insurance complying with article 6 (Motor Vehicle Financial Security Act) of the New York Vehicle and Traffic Law covering:"

(2) Authorized insurance company (FH-1): "An authorized New York insurer certifies that is has issued a liability policy complying with section 370 of the New York Vehicle and Traffic Law to:"

(3) Unauthorized insurance company.
(i) "the company has issued to the insured named below an automobile liability policy covering the vehicle described herein;

(ii) the company has filed a resolution and power of attorney pursuant to subdivision 4(c) of section 311 of the Vehicle and Traffic Law;

(iii) the vehicle insured hereunder is registered in the insured's state of residence; and

(iv) the company is authorized to transact business in said state."

(4) Authorized bonding company (FS-83): "An authorized New York insurer filed a financial security bond with the Department of Motor Vehicles complying with article 6 of the New York Vehicle and Traffic Law on behalf of:"

(5) Authorized bonding company (FH-1B): "An authorized New York insurer certifies that it has issued a bond complying with section 370 of the New York Vehicle and Traffic Law to:"

(6) Self-insurer (FS-80): "The registrant named has been granted approval having submitted satisfactory evidence for qualification as a self insurer under section 316 of article 6 of the New York Vehicle and Traffic Law".

(7) Financial security depositor (FS-79): "The registrant named has been granted approval having submitted satisfactory evidence for qualification as a financial security depositor under article 6 of the New York Vehicle and Traffic Law for the following motor vehicle".

(8) The registrant named below has been granted approval as a self-insurer, having submitted satisfactory evidence for qualification under section 370-3 of article 8 of the New York Vehicle and Traffic Law.

(f) The following four statements shall be machine or computer printed either on the front or the back of ID cards in accordance with section 32.16 of this Part:

THIS ID CARD MUST BE CARRIED IN THE INSURED VEHICLE FOR PRODUCTION UPON DEMAND.........................................................................

WARNING: Any person who issues or produces and ID card knowing that an Owner's Policy of Insurance is not in effect may be committing a misdemeanor. In addition, a person who presents an ID card if financial security is not in effect may be committing a misdemeanor..................................................................................

OR

WARNING: Any person who issues or produces and ID card knowing that an Owner's Policy of Insurance is not in effect may be committing a misdemeanor. In addition, a person who presents an ID card if insurance is not in effect may be committing a misdemeanor........................................................................................

The name of the registrant and the name of the insured must coincide.................................................................................................

REPLACEMENT VEHICLE NOTATION: DMV WILL ONLY PROCESS A VEHICLE CHANGE (RE-REGISTRATION) USING THE REPLACED VEHICLE'S CURRENT REGISTRATION.........................................................................................

(g) Additional information, including an insurance company's trademark or other symbol, may be added to an ID card as long as it does not interfere with the required information. No data, symbols background images, etc. shall appear in the area reserved for printing a compliant encrypted 2D bar code.

(h) Historical motor vehicle.

If the motor vehicle described on the ID card is to be registered as an historical motor vehicle, the word HISTORICAL must be computer-printed or machine-printed on the ID card. This indicates that coverage is provided not only for the motor vehicle described on the ID card but also for non-owned unregistered motor vehicles which would qualify for historical registration and which are operated by the registrant or his agent with the registration number plates assigned to the motor vehicle described on the ID card for the purpose of test driving in anticipation of possible purchase.

(i) Tow truck.

If the motor vehicle described on the ID card is to be registered as a tow truck, the words TOW TRUCK must be computer or machine-printed on the ID card in order to indicate compliance with specific levels of coverage required by the New York State Vehicle and Traffic Law.

(j) Replacement vehicle.

If the motor vehicle described on an ID card is a replacement vehicle, the first issuance of such ID card shall contain the notation "REPLACEMENT VEHICLE". A replacement vehicle is a motor vehicle that replaces a vehicle (the replaced vehicle) insured on an in force policy. A replacement vehicle is added to an in force policy on the same date that the replaced vehicle is deleted from said policy. This notation is required on the first issuance of vehicle specific ID cards required by this Part and non-vehicle specific ID cards issued in accordance with section 32.11(a) of this Part. Upon receipt of an ID card containing a "REPLACEMENT VEHICLE" notation:

(1) dealers registered under Part 78 of this Title shall not accept an ID card with the notation "REPLACEMENT VEHICLE" for an original registration; and

(2) DMV, its agents or any party authorized by the department to process registrations shall only process a reregistration (vehicle change) transaction using the replaced vehicle's current registration. Nothing herein shall preclude the issuance of replacement license plates in conjunction with any such reregistration transaction. A "REPLACEMENT VEHICLE" notation is not required for DMV to process a reregistration. A reregistration may be processed with or without a "REPLACEMENT VEHICLE" notation.

The "REPLACEMENT VEHICLE" notation shall appear on ID cards as follows:

(i) Permanent ID cards. The notation shall be computer-printed or machine-printed.

(ii) Temporary ID cards. The notation shall be computer-printed or machine-printed.

This subsection is not applicable to the New York State Insurance Identification Card 997-Self Insurer (FS-80) or ID cards issued for dealer and transporter registrations that are not vehicle specific.

A registrant may apply for an original registration upon surrender of registration items previously used for a replaced vehicle and presentation of an ID card without a "REPLACEMENT VEHICLE" notation.
