Section 8.5 - Waiver of written test

In addition to any other tests required, an applicant for a license, other than a renewal license, shall be required to pass a test with respect to the laws relating to traffic, the laws relating to driving while ability impaired, the ability to read and comprehend traffic signs and symbols, except that such written test shall be waived:

(a) if the applicant was formerly a resident of another state, the District of Columbia, Guam, Puerto Rico, the Canal Zone or a province of Canada and has become a resident of this State, and is or was, within one year prior to the date of application for a New York license, the holder of a valid license issued by the motor vehicle authority of his former residence; or

(b) [Reserved]

(c) if the applicant is applying for an original license after revocation of a prior New York license, provided that application is made within two years from the date subject was last validly licensed in this State.
