Section 8.3 - Exceptions

Notwithstanding the provisions of section 8.2 of this Part, a road test shall not be waived if the applicant:

(a) has failed a road test in New York within the last year;

(b) has been licensed in his prior jurisdiction of residence for less than six months, unless such applicant is the holder of a valid commercial driver's license that has been issued by another state or the District of Columbia;

(c) has any physical or mental disability which, in the discretion of the license examiner, warrants reexamination of driving ability; or

(d) is applying for a license which permits the operation of a class of vehicles which the applicant's previous license did not specifically cover unless a waiver of road test is specifically provided for by statute or by any other regulations of the commissioner.
