Section 4.4 - Restrictions on class DJ and MJ learner permit operation

(a) New York City. A class DJ or MJ learner permit holder may not operate a motor vehicle in New York City except that the holder of such permit may operate a motor vehicle within New York City from 5 a.m. to 9 p.m. when such person is under the supervision and control of a driver education teacher or driving school instructor and such vehicle is equipped with dual controls.

(b) Nassau and Suffolk Counties. A class DJ or MJ learner permit holder may not operate a motor vehicle in the counties of Nassau and Suffolk except that the holder of such permit may operate a motor vehicle in Nassau and Suffolk counties from 5 a.m. to 9 p.m. when accompanied by a licensed parent, guardian or one in a position of loco parentis, driver education teacher or driving school instructor.

(c) In all other areas of the state except the Counties of Suffolk and Nassau or the City of New York. A class DJ or MJ learner permit holder may operate a motor vehicle:

(1) from 5 a.m. to 9 p.m. under the immediate supervision and control of a person at least 18 years of age who holds a license valid in this State for the operation of the type of vehicle for which the learner permit holder has made application to obtain;

(2) from 9 p.m. to 5 a.m. only when accompanied by a licensed parent, guardian, person in loco parentis, driver education teacher or driving school instructor.
