Part 1030 - Requirements For The Operation Of Drug-free Substance Abuse Programs
Section 1030.3 - Drug-free prevention services

(a) Definitions. Drug-free prevention program shall mean a substance abuse program providing services designed to keep individuals from becoming substance-dependent and to alert, educate and inform individuals, special groups and the general public of the problems of substance abuse and dependence. These services may be provided in any appropriate community-based or school-based setting.

(b) Program administration and staffing.

(1) Each program shall have an administrator-supervisor on duty either onsite or at a central administrative location during the program's hours of operation. His/her duties shall include:
(i) overseeing the day-to-day operation of the program; and

(ii) supervising the work of all staff.

(2) Each program shall establish written procedures for program operation and control, and must provide for periodic evaluation of program performance against the program's stated objectives.

(3) In prevention programs which provide individual counseling services, there shall be, at a minimum, one full-time counselor for every 50 participants receiving individual counseling.

(4) Support services. Each program shall take steps to ensure that, as appropriate, a comprehensive range of social services, including vocational, educational, mental health, alcoholism and legal services are made available, as necessary, to each participant. The program can fulfill this responsibility by providing these services directly or by appropriate referral.

(5) Medical services. Neither a medical examination nor a health history is required for admission to a prevention program. However, each program must be concerned with the general health of the participants in the program and shall recommend appropriate medical care when indicated.

(6) Facility standards. Each prevention program shall have safe and adequate physical facilities appropriate for the conduct of the program.

(c) Services.

(1) Individual and group counseling services.
(i) These services may be provided to individuals who are substance abusers or are not yet substance abusers but are in an environment where such abuse is prevalent, or are considered to be at risk because of social, familial and other factors.

(ii) Screening procedures. Each individual who presents himself to the program shall be interviewed by a qualified staff member to determine the appropriateness of continuing services to the individual. The results of the interview shall be recorded and dated and include:
(a) presenting problems of the individual;

(b) assessment of the individual's need for services; and

(c) follow-up notes, documentation of any referral or other closing notes.

(iii) Admission procedures.
(a) If the assessment of the individual's need for services reveals that he requires additional counseling, or other services from the program beyond those received at the time of the interview, then a services plan must be developed for that individual.

(b) In addition, the reason for continued services must be recorded and there must be a notation in the record that the program rules of participation were discussed with the participant and that he indicated that he understood those rules and regulations.

(iv) Services plan.
(a) The services plan prepared must include as a minimum:
(1) the assignment of a service coordinator;

(2) delineation of service goals, including statement of counseling to be provided and support services needed, and a plan for meeting those needs.

(b) The services plan shall be prepared within 20 school or work days of the date of determination that services are to be continued, and shall be recorded in the participant record.

(v) Participant records.
(a) Each program shall maintain records for each individual seen by the program.

(b) For those individuals for whom it is determined that continued services are not needed, participant records must include:
(1) the participant's name or identification number and identifying data;

(2) record of screening, including all items required by subparagraph (ii) of this paragraph; and

(3) synopsis with date of screening.

(c) For those individuals for whom it is determined that continued services are needed, participant records must also include.
(1) services plan prepared in accord with this section with appropriate revisions;

(2) progress notes documenting the counseling and support services provided;

(3) documentation that the individual was informed of the rules for participation in the program and the voluntary nature of participation; and

(4) follow-up or other closing notes stating the reason(s) for discharge from the program.

(2) Education, information and referral services.
(i) Prevention programs may organize, arrange and conduct activities to alert, educate and inform individuals, specialized groups and the public of the problems of substance abuse and dependence and to refer individuals in need of substance abuse services to appropriate treatment resources.
(a) Such services may include, but are not limited to:
(1) the organization of speakers' bureaus;

(2) conduct of community presentations;

(3) presentations to faculty and school personnel;

(4) classroom and school presentations; and

(5) dissemination of informational materials.

(b) A prevention program may be established to provide only these services, or these services may be provided in conjunction with individual and group counseling prevention services.

(c) It is recognized that integral parts of many prevention programs, especially school based programs, are continuing education and information programs conducted for school personnel, parents and families and school age youth.

(ii) Prevention programs providing these services must have sufficient, qualified staff to provide appropriate services. In programs which also provide individual and group counseling, careful attention should be paid to staff workloads and specialized qualifications.

(iii) Each prevention program providing these services shall maintain records of the events, activities conducted or referrals made, including numbers of individuals involved, identity of groups served, the number of sessions of each activity conducted, the staff providing the service, and the nature of the activity.
