Subpart 635-1 - Background
Section 635-1.1 - Applicability

(a) This Part contains requirements applicable to programs, services or facilities (as specified herein) funded or certified by the Office for People With Developmental Disabilities, hereinafter referred to as OPWDD (see glossary).

(b) In a family care home, the sponsoring agency (see glossary) and the holder of the operating certificate shall be responsible for ensuring compliance with this Part as specified.

(c) This Part is controlling over any Part of 14 NYCRR insofar as the requirements herein may be concerned, unless said Part provides that it is controlling.
