Section 620.2 - Statutory authority

(a) Section 5.07 (b)(1) of the Mental Hygiene Law requires that there be a statewide comprehensive five-year plan for the provision of all State and local services for persons with developmental disabilities which is formulated from local comprehensive plans.

(b) Section 13.09 (b) of the Mental Hygiene Law grants the commissioner (see glossary, section 620.13 of this Part) the authority to adopt rules and regulations necessary and proper to implement any matter under his or her jurisdiction.

(c) Section 16.00 of the Mental Hygiene Law grants the commissioner the authority to adopt and promulgate any regulation reasonably necessary to implement and effectively exercise the powers and perform duties set forth in article 16 of the Mental Hygiene Law, which are necessary to maintain the consistent high quality of services provided within the State to its citizens with developmental disabilities.

(d) Article 16 of the Mental Hygiene Law addresses the planning process for services between OPWDD and the local governmental unit (see glossary, section 620.13 of this Part).
