(a) The commissioner shall review the application for certification of need for completeness of information within 10 business days of receipt. Within an additional five business days, the applicant shall be notified by certified mail of any lack of information, which shall be provided by the applicant within 30 calendar days or such additional time as may be requested by the applicant and approved by the commissioner. Failure to provide such information within the designated time shall constitute withdrawal of the application. Each party shall have 60 business days to review the application and submit findings and recommendations to the commissioner unless these planning bodies have reached an agreement with OPWDD and agree to waive the substantial review process.
(c) Upon receipt of a complete application, the commissioner shall provide a copy of such application to the office of the appropriate local governmental unit in the area to be served.
(d) The commissioner shall, within 90 business days of receipt of the complete application, make a decision on the application based on his or her review of recommendations by OPWDD staff, the report of the health systems agency, and the advice of the designated State health planning and development agency and the local governmental unit.
