Section 604.2 - Statutory authority

(a) Section 13.09 of the Mental Hygiene Law, grants the commissioner the power to adopt rules and regulations which are necessary and proper to implement any matter under his or her jurisdiction.

(b) Section 94 of article 6-A of the Public Officers Law, requires the Commissioner of OPWDD to publish regulations governing the access to records which will ensure that the personal privacy rights of persons on whom records are maintained are sufficiently protected.
