Part 588 - Medical Assistance Payment For Outpatient Programs
Section 588.3 - Applicability

(a) This Part applies to any provider of service which is licensed to operate an outpatient program for adults with a diagnosis of mental illness and children with a diagnosis of emotional disturbance, in accordance with Part 587 of this Title.

(b) This Part applies to any part of a general hospital as defined in article 28 of the Public Health Law which is licensed to operate an outpatient program for adults with a diagnosis of mental illness and children with a diagnosis of emotional disturbance, in accordance with Part 587 of this Title.

(c) This Part applies to a State-operated psychiatric center which is licensed to operate an outpatient program for adults with a diagnosis of mental illness and children with a diagnosis of emotional disturbance, in accordance with Part 587 of this Title provided, however, that this Part does not apply to designated partial capitation programs (e.g., pre-paid mental health programs).

(d) This Part and all other standards of reimbursement applicable to outpatient programs shall be effective contingent upon Federal financial participation.
