Section 585.13 - Fees for family care

(a) Fees for the provision of room, board and services to clients may be established by the commissioner, with the concurrence of the Division of Budget.

(b) Fees shall be adjusted to reflect each client's ability to pay. Fees charged recipients of public assistance or supplemental security income benefits shall not exceed amounts available to such persons under law less the personal needs allowance required to be reserved for the use of such person pursuant to State law and regulations.

(c) Subject to the availability of resources to clients, the commissioner may increase fees for family care homes to meet extraordinary expenses generally incurred by providers of family care services. Such increases in fees may be individually calculated to reflect extraordinary expenses actually incurred by each family care home.

(d) Such fees shall be established administratively and a record thereof maintained by the commissioner.

(e) Upon approval of a fee or a temporary increase in fees, the family care provider shall give the client 30 days' written notice of the implementation of the adjusted fee.
