Part 577 - Rates Of Reimbursement-hospitals Licensed By The Office Of Mental Health
Section 577.3 - Applicability

(a) These regulations apply to any hospital licensed pursuant to article 31 of the Mental Hygiene Law and issued an operating certificate in accordance with Part 582 of this Title.

(b) These regulations establish rates of payment made by government agencies pursuant to title 11 of article 5 of the Social Services Law for services provided by hospitals, as defined herein. All payments by such agencies shall be at rates certified by the commissioner and approved by the Director of the Budget in accordance with section 577.8 of this Part.

(c) These regulations do not apply to hospitals licensed pursuant to article 28 of the Public Health Law and issued an operating certificate in accordance with Part 580 of this Title, residential treatment facilities for children and youth issued an operating certificate in accordance with Part 584 of this Title, and hospitals within the Office of Mental Health.

(d) In the event that the State cannot provide assurances satisfactory to the secretary of the Department of Health and Human Services that the rates of payment comply with the Medicare upper limit requirement, such rates of payment shall be adjusted proportionally as necessary to meet Federal requirements for securing Federal financial participation.
