Part 540 - Patients Committed To The Custody Of The Commissioner Pursuant To Cpl Article 730
Section 540.5 - Unescorted furlough

(a) Unescorted furlough may not be granted to any patient who is currently subject to a temporary order of observation, an order of commitment or an order of retention.

(b) Unescorted furlough may be granted by the clinical director to a patient retained as a civil patient after the expiration of an order issued under article 730 of the Criminal Procedure Law, after consultation with the hospital forensic committee as required in section 540.9 of this Part and compliance with the notice requirements described in section 540.10 of this Part.
