Part 540 - Patients Committed To The Custody Of The Commissioner Pursuant To Cpl Article 730
Section 540.4 - Escorted furlough

(a) Escorted furlough may not be granted to a person who is subject to a temporary order of observation or an order of commitment.

(b) Escorted furlough may be granted by the clinical director to a patient who is currently subject to an order of retention, after consultation with the hospital forensic committee as required by section 540.9 of this Part, and notice in compliance with the procedures described in section 540.10 of this Part.

(c) Escorted furlough may be granted by the clinical director to a patient retained as a civil patient after the expiration of an order issued under article 730 of the Criminal Procedure Law, after consultation with the hospital forensic committee as required in section 540.9 of this Part and compliance with the notice requirements described in section 540.10 of this Part.
