Section 521.2 - Legal base

(a) Section 7.07 of the Mental Hygiene Law sets forth the authority of OMH for assuring the development of plans, services and programs for the mentally ill. The office has the responsibility to provide appropriate facilities and encourage the provision of facilities by local governments and community organizations and agencies.

(b) Sections 7.09 and 31.04 of the Mental Hygiene Law grant the Commissioner of Mental Health the power and responsibility to adopt rules and regulations necessary and proper to implement any matter under his jurisdiction.

(c) Sections 41.15, 41.18 and 41.23 of the Mental Hygiene Law set forth the authority of the Office of Mental Health to provide State aid funding for the capital costs for community mental health facilities, pursuant to a local services or unified services plan.

(d) Sections 75.17 and 75.19 of the Mental Hygiene Law set forth the authority of the commissioner to approve mortgage loans for funds available from the Housing Finance Agency.

(e) Section 75.25 of the Mental Hygiene Law sets forth the authority of the commissioner to make, alter, amend and repeal rules and regulations for the supervision, examination, regulation and audit of companies.

(f) Subdivision 13-c of section 5 of the Facilities Development Corporation Act sets forth the authority of the commissioner to promulgate regulations with respect to financing or refinancing of community facilities by voluntary agencies with the proceeds of funds realized from the sale of tax-exempt bonds and notes issued by Medical Care Facilities Finance Agency.
