Section 520.2 - Legal base

(a) Section 7.09 of the Mental Hygiene Law grants the Commissioner of Mental Health the power and responsibility to adopt regulations that are necessary and proper to implement matters under his or her jurisdiction.

(b) Article 6-A of the Public Officers Law sets forth agency obligations for maintaining, disclosing, granting access to and retention of records containing personal information about individuals, and requires the Office of Mental Health to establish rules and regulations necessary to comply with the article.
