Part 517 - Transfer Or Referral Of Patients For Admission To Psychiatric Hospitals
Section 517.5 - Transfer of emergency patient

(a) A patient on emergency admission status may be admitted to another hospital pursuant to the provisions of article 9 of the Mental Hygiene Law governing involuntary admission on application supported by medical certification, without the necessity of obtaining an order of transfer.

(b) When transfer of a patient is effected pursuant to subdivision (a) of this section:

(1) the sending hospital shall give to the Mental Hygiene Legal Service prior written notice of such transfer; and

(2) the receiving hospital shall give notice in accordance with section 517.4(i) of this Part.

(c) When, pursuant to subdivision (a) of this section, a patient who is under 21 years of age and is a recipient of medical assistance is transferred to a State-operated psychiatric center, a certification of need form shall be completed by the sending hospital and submitted to the receiving hospital upon transfer. The certification of need form shall be completed as described in section 517.4(b)(3) of this Part. If it is determined that the transfer of a patient is necessary in order to prevent serious impairment or deterioration of the health of the patient, or to prevent immediate serious physical harm to the patient or others, the sending hospital is not required to complete a certification of need form. In such cases, the receiving hospital shall complete the certification of need form within 14 days after the patient's admission to the receiving hospital.
