Section 510.5 - Designation and responsibilities of records access officers

(a) The records access officer of the Office of Mental Health's (OMH) central office shall be a lawyer in the office of counsel, designated by the Commissioner. The address for the records access officer is 44 Holland Avenue, Albany, New York 12229. The records access officer of each OMH operated psychiatric center is the facility director or his or her designee, who may be contacted at the business address of the applicable psychiatric center.

(b) The records access officer is responsible for:

(1) maintaining a reasonably detailed current list, by subject matter, of records maintained by the organization;

(2) assisting the requester in identifying requested records, if necessary;

(3) determining the appropriateness of public access to requested records;

(4) providing documents to persons who have been granted access; and

(5) documenting denials of requests for access and maintaining a file of such denials.
