Section 85.8 - Premises

(a) The certificate holder shall maintain premises appropriate and adequate for the safe and effective examination, diagnosis, care, treatment, and rehabilitation or training of all persons served.

(b) The space provided shall be both adequate and appropriate for:

(1) The maintenance of privacy for interviews between staff members and the persons served,

(2) The comfort and convenience of those waiting for services,

(3) Accommodation of activities and equipment necessary to special activities such as group discussions, play therapy, medical examinations, occupational therapy, speech and hearing therapies, or others which are regularly provided, and

(4) Controlled access to and maintenance of case records.

(c) If medications are stored or dispensed on the premises of the facility, the certificate holder shall provide for controlled access and maintenance of supplies in accordance with all applicable Federal, State, and local laws and regulations.

(d) The premises, whether stationary or portable, shall comply with all local zoning and building laws, regulations and ordinances.

(1) Heating, lighting and ventilation shall be adequate for the comfort and well-being of the persons served and the employees.

(2) A written certificate of occupancy by the local building inspection authority shall be retained in the records of the facility.

(e) The premises shall comply with all local fire safety, sanitation and health laws, regulations and ordinances. Written certification of approval by all authorized local authorities shall be retained in the records of the facility.

(f) Mobile premises and their use shall comply with all applicable laws, regulations and ordinances.
