Section 18.8 - Return of prisoner to jail

A prisoner admitted to a hospital pursuant to this Part shall be returned to the jail when it is determined that he is no longer in need of involuntary care and treatment, unless, subject to the approval of the court, the prisoner voluntarily agrees to continuation of care and treatment. Such continuation of treatment on a voluntary basis shall be subject to these regulations and to all the provisions of the Mental Hygiene Law applicable to voluntary patients.
