Additional Definitions
A transitional facility is one that provides services rendered at day training centers for social and vocational rehabilitation including habilitation and instructional classes, day hospitals, night hospitals, summer rehabilitation programs, rehabilitation workshops, activity centers, halfway houses or other type of non-permanent domiciliary arrangement, but does not include State mental hospital inpatient care, State school residence or outpatient psychiatric clinic treatment.
Testing and evaluation are tests, examinations, evaluative or diagnostic statements made by a psychiatrist, physician psychologist, social worker, rehabilitation specialist, educational specialist, occupational therapist or other professional person in a related discipline which appraise a person's capacity to acquire occupational skills and acceptable patterns of social and employment behavior and that assess the individual's capacity for productivity in an educational social or work situation, real or simulated.
Therapeutic recreation is a habilitative or rehabilitative program consisting of social and recreational activities designed to help the mentally retarded person improve his personal adjustment and his relationship with others.
A job try-out or on-the-job training is a work experience within a sheltered work-shop or in conjunction with outside industry planned for the purpose of helping a mentally retarded person acquire employment knowledge, develop skills or of assessing his readiness for job placement.
Personal adjustment training or work adjustment emphasizes the development of adjustment to work rather than the development of a particular skill. This may be achieved by long-term exposure to a real work situation stressing personal and social skills required to get along with others in a work setting the development of work tolerance, appropriate work habits and emotional stability in responding to work pressures.
Job placement and follow-up service is that aspect of a workshop program in which a mentally retarded person is placed in a job with subsequent determination as to whether he has been suitably placed in competitive employment to the satisfaction of himself, his family and the employer. It also involves a decision as to whether the mentally retarded person needs further service and if so what kind.
Supportive services are designed to strengthen the abilities of mentally disabled persons to help them move ahead toward maximum independent functioning by working with their total environments including home and family, job and employer and the community as a whole.
Perceptual-motor training is a service designed to alleviate existing developmental deficit in sensory perception, motor learning and integrated functioning through a series of graded activities which are based on prior evaluation.
Mileu therapy is the total environment of a program including physical surroundings, equipment and staff attitudes integrated in such a way as to enhance the effectiveness of other therapeutic activities that improve the mentally retarded person's abilities.
The following professional disciplines must be licensed, certified or registered in the State of New York:
A physician or other specialist in the medical profession must have a license to practice medicine in the State of New York and one year of acceptable experience. A psychiatrist, in addition must have completed a three-year residency in an approved psychiatric program.
A psychologist must be certified in the State of New York. Certification is waived for psychologists employed by public agencies.
A social worker must be certified in the State of New York. A master's degree from an approved school of social work that includes two years of part-time supervised field work is required for certification. Certification is waived for social workers employed by public agencies.
A nurse must be registered with the State of New York. To qualify for registration a nurse must have graduated from an accredited school of nursing that includes the proper academic training and supervised student nursing.
A physical therapist or speech therapist must be licensed by the State of New York.
A teacher in a rehabilitation program in an institution must hold a bachelor's degree from a recognized four-year college or university, which includes satisfactory completion of the necessary hours in the subject of the teaching specialty or specialties.
Other specialists including occupational therapists, for whom licensure, certification or registration is not required by New York State must be eligible for membership in their national standard-setting organization.
(1) Section 100.3(d) (1) of the New York State Community Mental Health Services Program reads in part: ". . . . Psychiatric consultation shall be required in the selection of persons to be served and psychiatric supervision shall be required in all instances where the program includes medical treatment."
Section 100.3(d) (2) reads in part: ". . . . Rehabilitation services shall be considered to include day training centers for those suffering from or who have suffered from mental illness, mental deficiency, epilepsy or behavior or emotional disorders who are not eligible for special educational classes in public school because of age, or who are so handicapped by their disorders in the opinion of medical and/or psychological and/or educational authorities as to be unsuitable for special education classes in public schools."
Discharge policies shall take the following into consideration:
The child has been accepted for regular or special classes in the public school system.
The adult has been placed in a job and requests no further service from the day training center or workshop except possibly occasional follow-up to check on current job status.
The client requires another service not offered by the day training center.
The client and his family have moved out of the geographic area served by the day training center.
The client shows gross lack of cooperation with the agency program and procedures or is found to be disruptive to the disadvantage of other program participants.
The following certifications or approvals are required if applicable. In relation to premises:
Written approval by the local fire department that the premises are fire-safe.
Approval from the building department that the building or space in the building is in safe repair for the purposes or the program.
Written indication where required front the zoning authority that the day training center is in the proper zone.
Certificate of occupancy from the building department that the premises may be used for a day training center unless the program is housed in a pubic [public] building in which case this requirement is waived.
Approval as required by the health and sanitation department if food is prepared on the premises.
