Section 830.3 - System of penalties

(a) The employer is notified of a violation by the commissioner by issuance of a notice of violation and order to comply, which fixes a reasonable abatement date for each violation.

(b) If an employer fails to abate a violation by the abatement date, penalties are assessed by the commissioner by issuing a notification of failure to abate which establishes the amount of the penalty to be assessed for each day until the compliance date.

(c) Pursuant to Labor Law, section 27-a(6), an employer who fails to correct a nonserious violation by the abatement date may be assessed a civil penalty of up to $50 per day until the compliance date. An employer who fails to correct a serious violation by the abatement date may be assessed a civil penalty of up to $200 per day until the compliance date.
