Section 303.3 - Resolution of workers' compensation claims of certain officers and employees of the workers' compensation board and the state insurance fund

(a) Notwithstanding subdivision 1 of section 20 of the Workers' Compensation Law, any claims for compensation of the individuals described below, including claims resulting from the death of such individuals, shall not be within the jurisdiction of the Workers' Compensation Board but shall instead be determined in accordance with the rules and regulations herein set forth:

(1) the chair, vice chair and members of the Workers' Compensation Board;

(2) managerial or confidential employees of the Workers' Compensation Board and State Insurance Fund who are allocated to a grade M1 or above pursuant to section 130 of the Civil Service Law;

(3) judges and conciliators of the Workers' Compensation Board; and

(4) the executive director, deputy executive directors and members of the board of commissioners of the State Insurance Fund.

(b) An officer or employee identified in subdivision (a) of this section shall hereinafter be referred to as a designated officer or employee.

(c) The Workers' Compensation Board and the State Insurance Fund shall maintain current a list of all designated officers and employees within their respective agencies, and shall notify designated officers and employees that their claims for compensation are subject to the terms of subdivision 2 of section 20 of the Workers' Compensation Law and this Part.
