An ACO shall submit data to the commissioner annually or at such other times as requested and in such manner and form as prescribed by the commissioner regarding ACO participants, patient characteristics, utilization of services, quality metrics, shared savings or losses information, complaints and grievances and other information deemed necessary to monitor the ACO's operations, eligibility and compliance. Entities with certificates of authority reflecting the provision of state action immunity pursuant to section 1003.14(a) of this Part shall submit such materials or information as is requested by the department for purposes of active state supervision.
