An eligible recipient or member resident who believes that the NF has erroneously determined that he or she should be transferred or discharged may request a HSD administrative hearing. A NF must provide an eligible recipient or member resident notice of the proposed transfer or discharge. The notice must inform the eligible recipient or member resident of his or her right to request a hearing, the method by which a hearing can be requested and his or her right to present evidence in person or through his or her authorized representative; see 8.354.2 NMAC and the MAD MCO policy manual.
