A provider, its agents and employees are independent contractors who perform professional services for eligible recipients served through health care programs administered by HSD or its authorized agents and are not employees of HSD, or the state of New Mexico. A provider shall not purport to bind neither HSD nor the state of New Mexico to any obligation not expressly authorized, unless HSD has given the provider express written permission to do so.
