The regulations set forth herein are promulgated by the Secretary of the New Mexico Department of Health, by authority of N.M. Stat. Ann. 1978, Section 9-7-6 E, and pursuant to the Special Supplemental Nutrition Program for Women, Infants and Children established under Section 17 of the Child Nutrition Act of 1966, as amended, 42 USC Section 1786, and laws and regulations set forth in 7 CFR Section 246, 7 CFR Section 278.1, 7 CFR Section 15, and N.M. Stat. Ann. 1978, Section 30-16-7 (Cum.Supp. 1987); and other applicable provisions of state and federal law. These regulations shall be administered and enforced by the New Mexico Department of Health, Public Health Division.
