Section 7.20.12.2 - SCOPE

All residential treatment services that provide children and adolescent mental health services as specified in these regulations.
A. These regulations apply to the following:
(1) public or private, profit or nonprofit
residential facilities providing services as outlined by these
regulations;
(2) any facility
providing services as outlined by these regulations which by state or federal
law or regulation must be licensed by the state of New Mexico.
B. These regulations do not apply to the following:
(1) offices and treatment
room of licensed private practitioners;
(2) agencies providing treatment foster care
services which are licensed by the protective services division of the
department;
(3) room and board
facilities in public or private schools accredited or supervised by the New
Mexico state department of education and inspected for fire and safety by the
New Mexico state fire marshals office;
(4) children/adolescent crisis shelters which
provide short term emergency 24-hour-a-day, living accommodations to children,
which are licensed by the child care bureau of the department;
(5) any facility licensed as a community home
or a multi-service agency.
