A new facility may be located in an existing building or a newly constructed building:

A. If opened in an existing building a variance may be granted for those building requirements the facility cannot meet under the same criteria outlined in Section 18 [now 7.13.2.18 NMAC], if not in conflict with existing building and fire codes. This is at the sole discretion of the licensing authority.

B. A new facility opened in a newly constructed building shall meet all of the requirements of these regulations.
