Section 20.11.39.2 - SCOPE

A. Applicability: 20.11.39 NMAC applies to the following stationary source categories in the city of Albuquerque and Bernalillo county.
(1) Emergency stationary reciprocating
internal combustion engines (ES-RICE) as defined in 20.11.39.7 NMAC, except as
otherwise provided in this Part.
(2) Gasoline dispensing facilities (GDF) as
defined in 20.11.39.7 NMAC, except as otherwise provided in this
Part.
B. Exemptions:
(1) 20.11.39 NMAC
does not apply to stationary sources within Bernalillo county that are located
on Indian lands over which the Albuquerque-Bernalillo county air quality
control board lacks jurisdiction.
(2) 20.11.39 NMAC does not apply to:
(a) stationary sources that, in the
aggregate, constitute a major source under the applicable provisions of
20.11.42 NMAC, which are located on one or more contiguous or adjacent
properties, and which are under common control of the same person;
(b) any non-emergency stationary RICE
engines;
(c) sources which contain
emission units:
(i) other than ES-RICE and
GDFs, as defined in 20.11.39.7; and
(ii) that require a construction permit
pursuant to 20.11.41 NMAC;
(d) Part 39 sources that are part of a Title
V permit; or
(e) Part 39 sources
located at a single family private residence.
