A. Beginning model year 2027 and subsequent years, this 20.11.104.118 NMAC (Exhaust Emission Standards for Heavy-Duty Engines) applies to manufacturers that deliver for sale, offer for sale, sell, import, deliver, purchase, rent, lease, acquire or receive heavy-duty vehicles, heavy-duty engines or other motor vehicle engines pursuant to the requirements of CCR, Title 13, Sections 1900, 1956.8, 1961.2, 1965, 1968.2, 1971.1, 2035, 2036, 2166, 2166.1, 2167 through 2170, 2111 through 2119, 2121, 2123, 2125 through 2131, 2133, 2137, 2139 through 2149, 2423 and 2485.

B. Each manufacturer subject to 20.11.104.118 NMAC MAC (Exhaust Emission Standards for Heavy-Duty Engines) shall comply with the heavy-duty engine emissions standards and other requirements set forth in CCR, Title 13, Sections 1900, 1956.8, 1961.2, 1965, 1968.2, 1971.1, 2035, 2036, 2166, 2166.1, 2167 through 2170, 2111 through 2119, 2121, 2123, 2125 through 2131, 2133, 2137, 2139 through 2149, 2423 and 2485. Compliance shall be based on the motor vehicles subject to 20.2.91.118 NMAC (Exhaust Emission Standards for Heavy-Duty Engines) and 20.11.104.118 NMAC (Exhaust Emission Standards for Heavy-Duty Engines) that each manufacturer delivers for sale, offers for sale, sells, imports, delivers, purchases, rents, leases, acquires or receives in New Mexico, and shall be determined on a statewide basis.
