Section 16.19.17.3 - STATUTORY AUTHORITY

Section 26-1-18 of the New Mexico Drug, Device and Cosmetic Act, Chapter 26, Article 1 NMSA 1978, authorizes the board of pharmacy to promulgate regulations for the efficient enforcement of the act and to declare, by regulation, a substance a dangerous drug. Section 61-11-6.A(6) NMSA 1978 authorizes the board to provide for the licensing of all places where dangerous drugs are stored, distributed, dispensed or administered and provide for the inspection of the facilities and activities. Section 26-1-16.A(2) NMSA 1978 authorizes the board to license any person to sell, dispose of or possess any dangerous drug. Appropriate records of receipt and disposition must be kept.
