Section 8:43I-2.7 - Right to hearing

(a) Persons disqualified from certification due to a false sworn statement and application as required by 8:43I-2.1(a) shall be granted a hearing only if they are contesting the accuracy of the criminal history record background check. No person so disqualified shall be permitted to establish rehabilitation, nor shall a hearing be granted to provide for an evaluation of rehabilitation pursuant to 26:2H-84(d).

(b) Persons disqualified from certification for failure to establish rehabilitation shall be entitled to a hearing challenging the accuracy of the criminal history record background check, the denial of a determination of rehabilitation, or both.

(c) All hearings authorized by this chapter shall be held by and under the rules of the Office of Administrative Law, N.J.A.C. 1:1, pursuant to 52:14B-1 et seq.
