(a) To provide for public participation in the Department's enforcement process, the Department shall:
1. Investigate and
provide responses to all citizen complaints submitted under Department
procedures;
2. Not oppose
intervention by any citizen when permissive intervention may be authorized by
statute, rule, or regulation; and
3. Publish notice of any proposed settlement
of a Department enforcement action in the DEP Bulletin and provide at least 30
calendar days for public comment on the settlement.
