(a) Pursuant to 13:20-35, the Department may petition to the Attorney General to bring a criminal action against any person who:
1. Purposely or negligently violates any provision of 13:20-32, a Highlands Preservation Area Approval issued pursuant to 13:20-34, or any rule or regulation adopted pursuant to the Act;
2. Commits such an offense under (a)1 above a second time; or
3. Knowingly makes a false statement, representation, or certification in any application, record, or other document filed or required to be maintained under the Act.
