Section 7:36-4.6 - Acquisition of agricultural lands

(a) A local government unit may apply for Green Acres funding to acquire farmland for recreation and conservation purposes when there is a willing seller, the property is on the market, the property is the subject of a pending or approved subdivision or site plan application for non-farm purposes, the property is under contract of sale for non-farm purposes, or the property is integral to the project.
(b) If farmland is located within an Agricultural Development Area established under the 1983 Agriculture Retention and Development Act, 4:1C-11 et seq., at the time of application for Green Acres funding, the local government unit shall demonstrate that the owner of the farmland has not applied to sell the farmland or a development easement to the State or county in accordance with that Act, or that the owner has applied to sell the farmland or a development easement and the application was not approved.
