(a) A nonprofit may apply for Green Acres funding to acquire farmland for recreation and conservation purposes when there is a willing seller.
(b) If farmland is located within an Agricultural Development Area established under the 1983 Agriculture Retention and Development Act, 4:1C-11 et seq., at the time of application for Green Acres funding, the nonprofit shall demonstrate that the owner of the farmland has not applied to sell the farmland or a development easement to the State or county in accordance with that Act, or that the owner has applied to sell the farmland or a development easement and the application was not approved.
