Section 7:26E-5.4 - Remedial action requirements for historic fill material

(a) Notwithstanding the presumptive remedies for residences, schools, and child care centers required pursuant to 7:26E-5.3(a), there is a rebuttable presumption pursuant to N.J.S.A. 58:10B-12h that the remedial action for soil contamination associated with historic fill material is the establishment of engineering and institutional controls pursuant to N.J.A.C. 7:26C-7.

(b) The ground water classification exception area established pursuant to 7:26E-4.7(b) shall remain effective indefinitely. However, a ground water remedial action permit is not required for the ground water classification exception area.
