(a) A water usage certification issued by the Department in consultation with the county agricultural agent may include the right to construct, repair or reconstruct dams or other related structures provided that any proposed work to construct, repair or reconstruct dams or other related structures shall comply with 58:4-1 et seq. and all other applicable laws and regulations.
(b) In the case of a water usage certification issued pursuant to (a) above, a stream encroachment permit for irrigation headgates and tidegates along the banks of a stream shall not be required by the Department.
