Section 7:1K-9.11 - Classes of information which are not confidential information

(a) Without limiting the ability of the Department to determine that information not listed in this section is not confidential information, the following types of information are not confidential information:

1. The name, address and business telephone number of a facility and of its owner or operator and the registered agent of such owner or operator;

2. The types and quantities of hazardous substances present at a facility;

3. Information contained in an administrative order or notice of civil administrative penalty assessment issued under 7:1K-3.10 or 7:1K-12;

4. Any other information required to be publicly disclosed pursuant to any other act, administrative rule, or regulation;

5. Any information for which a trade secret claim is prohibited by 7:1G-6.5; and

6. Any information submitted electronically pursuant to 7:1K-5.1 and 6.1.
