Section 7:1F-7.2 - Scope

(a) This subchapter establishes procedures governing the Department's issuance of civil administrative orders and commencement of a civil action for violation(s) of any provisions of the Act, this chapter, or any order, permit, or operating authority issued pursuant thereto. This subchapter shall also govern the procedures for requesting an adjudicatory hearing on an administrative order, or a Department decision on an application for an approval or permit, as provided at N.J.A.C. 7:1F-7.4.

(b) Nothing in this subchapter is intended to affect the Department's authority to revoke or suspend any permit, or other operating authority issued under the Act. Specifically, the Department may revoke or suspend a permit, or other operating authority, without regard to whether an administrative order has been or will be issued pursuant to this subchapter or any other Department statute.

(c) Each violation of any provision of the Act or this chapter, or violation of any administrative order, permit, or other operating authority promulgated or issued pursuant thereto shall constitute a separate and distinct offense.

(d) Each day during which a violation continues shall constitute an additional, separate, and distinct offense.
