Section 7:1E-2.9 - Flood hazard areas

(a) Hazardous substances stored within the tidal floodplain as delineated by the Federal Emergency Management Agency or the floodway of any watercourse as delineated by the Department in 7:13-7.1 shall be adequately protected so as to prevent such hazardous substances from being carried off by or being discharged into flood waters.

(b) Hazardous substances stored within an area known by the owner or operator of the major facility to be subject to a high probability of flooding or washout shall be adequately protected so as to prevent such hazardous substances from being carried off by flood waters or being discharged.
