Section 7:19-2.5 - Application review

(a) The Department will make a preliminary review of each application as follows:

1. If the application does not contain all documents and information required pursuant to 7:19-2.2 through 2.4, the Department may, at its discretion, within 20 working days of receipt of the application, return the application or advise the applicant in writing as to the additional information required to make the application administratively complete and the date by which the additional information must be received by the Department. If an application is returned, the applicant will be advised in writing as to the additional information required to make the application complete.

2. If the application contains all documents and information required pursuant to 7:19-2.2 through 2.4 and is determined to be administratively complete, the Department, within 20 working days of receipt of the application, will so advise the applicant in writing.

(b) The Department will make a technical review of each application within 20 working days after it declares the application administratively complete as follows:

1. If the application does not contain sufficient technical information as required pursuant to 7:19-2.2 through 2.4 or if the technical information requires clarification, the Department will so advise the applicant in writing and establish a date by which additional or clarifying information must be received by the Department. If additional or clarifying information is not received by the specified date, the Department may:
i. Return the application; or

ii. Extend the date by which the applicant must provide the additional or clarifying information; or

iii. Deny the application.

(c) The Department will perform a detailed analysis of the technically complete application and will develop a staff recommendation to issue the permit or deny the application. The staff recommendation will include any conditions to be attached to the permit if the recommendation is to issue the permit or an explanation of the reasons for denial if the recommendation is to deny the application.

(d) The Department will issue a permit renewal, with any conditions deemed appropriate by the Department, for the same allocation, except that the Department may, after notice and public hearing, if requested by the applicant, pursuant to 7:19-2.7 through 2.11, reduce the allocation to that quantity currently diverted, subject to contract, or reasonably required for a demonstrated future need.
