Section 7:14A-6.3 - Establishing permit conditions

(a) In addition to conditions required in all permits for all programs pursuant to 7:14A-6.2, the Department shall establish conditions in permits for the individual programs, as required on a case-by-case basis.

(b) All NJPDES permits shall include any applicable Federal or State statutory or regulatory requirements which take effect prior to final permit issuance. 7:14A-15.14, Reopening of the public comment period, provides a means for reopening NJPDES permit proceedings at the discretion of the Department where new requirements become effective during the permitting process and are of sufficient magnitude to make additional proceedings desirable. An applicable requirement is also any requirement which takes effect prior to the modification or revocation and reissuance of a permit, to the extent allowed in 7:14A-16.4.
