Section 7:14A-25.10 - Requirements for large and medium municipal separate storm sewer discharges

(a) Application requirements for operating entities for discharges to surface water from large and medium municipal separate storm sewers are contained in 40 C.F.R. 122.26(d), which is incorporated into this chapter by reference. Also incorporated into this chapter by reference, for purposes of this subsection only, are the definitions at 40 C.F.R. 122.26(b)(5) and (6) of "major municipal separate storm sewer outfall" and "major outfall." References to a "NPDES permit" or "permit" in 40 C.F.R. 122.26(d) shall be understood to mean a NJPDES permit under this chapter, unless the context clearly indicates otherwise. References to an "illicit discharge" in 40 C.F.R. 122.26(d) shall be understood to mean an "illicit connection" as defined at 7:14A-1.2. Any operating entity for a discharge under this subsection is exempt from the requirements of 7:14A-4.3(a)11 and 15 through 24, (c) through (e) and 4.4(a) and (b)3 through 7.

(b) The operating entity for a large or medium municipal separate storm sewer system that discharges to surface water shall submit an annual report by the anniversary of the date of the issuance of the NJPDES permit for such system. The report shall include the information required under 40 C.F.R. 122.42(c), which is incorporated into this chapter by reference.
